This week I have settled a claim for a lady client who was involved in a Road Traffic Accident and suffered whiplash injuries to her neck and back. We were able to obtain physiotherapy for our client which assisted with her recovery before obtaining damages for her of £3,200.00.
On Thursday 17.11.16 the Government published proposed reforms to the law which, if enacted, will remove or reduce injury compensation for minor whiplash cases and increase the small claims limit for all personal injury claims from £1,000 to £5,000. A consultation period has started and will end in the new year.
If the reforms become law they will have a huge effect on Claimants and solicitors will, in most cases, be unable to achieve fair settlements for clients as we have in our case this week. Millions of people will be denied access to justice if these reforms are introduced and will either have no claim to pursue after an accident or have to take claims in person against insurers and their lawyers. Insurance companies will make greater profits. They claim that we will all see a reduction to our motor insurance premiums of £40 to £50 each, but there is no guarantee that there will be any reductions, particularly after the Chancellor of the Exchequer increased Insurance Premium Tax earlier this week.
