Access to Justice

Employment Law

Supreme Court Rules Employment Tribunal Fees unlawful

In a momentous ruling the Supreme Court have ruled that the Government’s policy of requiring Claimants to pay fees to bring a claim in the Employment Tribunal is unlawful. Tribunal fees were deemed unlawful because they prevent access to justice and because they are indirectly discriminatory, particularly against women who are more likely to work part time and are therefore Read more…

Access to Justice Personal Injury

Another client whose access to justice would be denied by the Government’s proposed Personal Injury Reforms

This week I have settled a claim for a lady client who was involved in a Road Traffic Accident and suffered whiplash injuries to her neck and back. We were able to obtain physiotherapy for our client which assisted with her recovery before obtaining damages for her of £3,200.00. On Thursday 17.11.16 Read more…

We are about to obtain compensation for a Sheffield pensioner in his eighties who suffered multiple injuries when he fell over due to a dangerous defect in a local supermarket car park. He was lucky not to suffer a serious head injury and is likely to be left with permanent Read more…

Justice: a level playing field?

In November, the Government announced planned reforms to personal injury law which would see claims with an injury value of up to £5,000.00 being handled in the Small Claims Court.  The thinking behind this is that it will reduce insurance premiums for consumers.  This is something that is heavily supported by the Read more…

Increasing the small claims limit will block access to justice

I was recently asked by a colleague how the proposed reforms to the personal injury sector would have affected our clients, had they been in place one or two years ago. One case sprang to mind that really shows how the increase to the small claims limit would have prevented Read more…
