We were instructed by a gentleman in his thirties who was involved in a Road Traffic Accident. He was the driver of a vehicle and was stationary at a crossroads. As he manoeuvred through the junction, the Defendant, who was driving in the opposite direction, turned into his path and collided with the front of our client’s vehicle causing injury to him and all his passengers.
What we did next
Liability was admitted from the outset and we were able to arrange rehabilitation in the form of physiotherapy. Unfortunately, the treatment did not assist the Claimant so we worked with the treating physiotherapist to establish the most appropriate form of treatment. We arranged for the client to receive Acupuncture and attend Pilates classes. After many months, the Claimant began making progress and went on to make a full recovery.
The Outcome
Once the rehabilitation had been finalised, we were able to settle the matter for just over £7,000.00.
Case two: Slip on left out cardboard
Jonathan Stittle has just settled a claim for a lady in her forties who was injured when she visited her local branch of a nationally-known retailer of home furnishings.
She was leaving the premises when she slipped and fell on a sheet of cardboard that had been left on the shop floor. Her injuries included a badly sprained ankle and a twisted back.
The insurance company concerned, a multinational group based in Europe, denied liability stating that the store operated a reasonable system of inspection of the floors on a frequent basis.
What we did next
We advised the client to obtain a medical report and start Court proceedings. Soon after we did so, the insurer appointed solicitors from its panel who are based in Liverpool.
The solicitors clearly realised that our client was likely to win because notwithstanding the inspection system, we had pointed out that the cardboard sheet in question was on the floor immediately adjacent to a member of staff operating a till who should have seen it and removed it, but failed to do so.
The Outcome
On their recommendation, the insurers quickly settled the claim for over £4000 and they will also have to pay our fees and those of their own solicitors. Of course, our client was delighted.
