As an occasional watcher of the soaps, I always pay attention when a character is injured in circumstances where they would be entitled to bring a claim against the person or organisation responsible for their injury.
It was on 21st October 2016 when poor Anna was badly burned after David Platt crashed a car in the street leading to an explosion which caused spilled petrol to set her alight.
Millions have seen her slow recovery from the burns she suffered to most of her legs, which in turn have caused her great upset not to mention a loss of earnings. She has received a large amount of unpaid care and assistance from her boyfriend Kevin Webster.
So why have we not seen her visit a personal injury lawyer? Does she not watch daytime TV, read newspapers or use the internet – all of which are full of adverts inviting people to start claims following injury? In reality most people who had suffered such a horrific injury would have been in contact with a lawyer by now.
The specifics of her claim
The accident arose as a result of David driving a car, which means that there will, by law, be an insurance company that will pay her compensation and the legal costs arising from the claim whether or not David was actually insured. The Motor Insurers’ Bureau pays victims of uninsured drivers as if they had been insured, if there is no insurance policy in force for the vehicle at the time of the accident.
Anna doesn’t need to worry about legal fees either. She will have no difficulty finding a solicitor who will not seek to be paid unless she wins. Most of whom will limit their fee to no more than 25% of her compensation for injury and past loss if the claim is successful.
She would be advised that there would probably be an early admission of liability followed by free private rehabilitation paid for by the insurers and an early interim payment to help with her finances. She might even be able to lend Kevin a few quid to help him renovate his garage!
So maybe it is that the producers don’t know how injury claims work in reality or do they perceive that we are all boring and wouldn’t make a good storyline? If the latter, I would gladly allow them to spend a day with us to see just how friendly and fun we really are!
