The annual campaign to raise awareness of the devastating effects of brain injury, Action for Brain Injury (ABI) week, is organised by one of the leading charities in this field, Headway, and this year will run from 17 – 23 May.

Brain injuries caused by trauma are one of the most common reasons for hospital admissions in England and Wales. Brain injuries generally arise from a fall, a car accident, an accident at work or an assault. It may be possible to claim compensation for such injuries if negligence can be established.

Working with clients who have an acquired brain injury requires experience and a good understanding of the many effects and problems which can arise. Brain function is complex, directing movement, behaviour, communication and thinking.

The brain continues to recover from injury for up to three years following trauma. While there are nearly always some long-term issues, the level of recovery can vary greatly. Brain injuries occurring in childhood sometimes resolve more favourably, whilst a brain injury sustained as an adult may be harder to recover from. Although recovery is rarely complete, some more minor brain injuries result in residual symptoms that may not be visible or immediately obvious and may be overlooked if the solicitor dealing with the claim is not experienced in what to look for.

All clients with an acquired brain injury present differently to one another. It is therefore important that these clients and their families are given sufficient time by their professional advisors in order to establish exactly how their brain injuries affect them in their daily life.

Our approach is to ensure that the brain-injured person is at the centre of a personalised claim designed to ensure that their individual needs are met, and that the compensation recovered reflects the effects of the brain injury on that individual in all aspects of their life.

Assessing a brain injury claim requires a substantial amount of expert evidence and a careful assessment of the individual client with detailed conversations with family, who will of course be very aware of how the brain injury has changed their loved one.
