TE Charity Assist Logo

Property is often the most valuable asset within an estate. If your charity has been left a share of an estate that includes property, any dispute concerning ownership or entitlement can reduce the value of the legacy gift your organisation ultimately receives.

We work with charities seeking to defend claims arising from property disputes connected to deceased estates. We will help protect your charity’s entitlement while seeking to resolve disputes as efficiently and proportionately as possible.

Questions of ownership

When an estate includes one or more properties, disputes can sometimes arise over who is entitled to their proceeds of sale, known legally as the beneficial owner.

Even if the property is in the name of the deceased, it may be held on trust for another person. In certain circumstances, someone may believe they have acquired an interest in the property if they have contributed to its purchase or upkeep.

Our Charity Assist team comprises experts in the resolution of property disputes. We will represent your interests and protect your charity’s entitlement against unsubstantiated or disproportionate claims.

Trespassers

When a property is left vacant, trespassers can also become a problem that administrators of an estate must resolve.

If your charity is named as an executor of a will containing property, you can instruct our property disputes specialists to evict unlawful trespassers on your behalf. We have vast experience in applying to the courts for possession orders and can do so independently, or as part of the overall administration of the estate.

Our team also advises on a wide range of Property Dispute matters beyond charitable legacies and estate administration. Find out more here.

A difficult landlord, lease renewal, boundary dispute or threat to your occupation are just some of the property issues that can adversely affect a charity’s operations, finances and reputation.
