Most of us are currently enjoying the warm weather and will be making the most of it by spending time outdoors.

Walking is a favourite pastime of many, especially when we have the beautiful Peak District and the Yorkshire Dales on our doorstep.

However, this is not always a pleasant experience and walkers may come across hazards such as: –

Public Footpaths

If you are using a public footpath, then it is the responsibility of the local authority to ensure that it is free from hazards and is subject to regular inspections. The local authority is also under a duty to inspect and repair/resolve any issues reported to them.

If the local authority does not undertake suitable/regular inspections and allows a pathway to become dangerous then it possible for a claim to be brought against them.

Private Land

A number of public rights of way cross through private land. It is the responsibility of the landowner to ensure that the pathway is kept hazard-free and is inspected on a regular basis.

A significant number of injuries that occur on public rights of way that cross private land tend to be caused by cattle.

Given the size and weight of cows and bulls, injuries caused when they attack are often very serious.

Most cattle are docile, but bulls or cows that feel threatened such as by dogs when calves are present may attack people without warning. Dairy bulls are banned from being kept at large in fields that contain a public right of way. Farmers are also advised not to keep mothers and calves in such fields as well as it is known that cows are likely to be very protective of their young.
