How to make childcare arrangements at Christmas

The festive period can be a stressful time for separated or divorced parents. Making arrangements for your child or children can be a difficult conversation and in some cases can lead to arguments or disputes. But it’s vital that these conversations take place in advance so your child or children have clarity around Christmas.

There are no legal provisions in place for child arrangements over Christmas, and Courts encourage that both parents get to spend quality time with their child/children over the Festive period. This means it’s important that parents mutually agree on a plan.

Our Family Law team have outlined their top tips when making childcare arrangements over the festive period to keep things merry for all concerned.

Ensure communication is good and start early

When making plans over the Festive period, it’s important to communicate clearly and start the discussion as early as possible. This gives the opportunity for both parties to make ample arrangements to accommodate your own plans and theirs.

Always prioritise the child’s needs

Putting your child or children first is vital when making arrangements with your former partner. The Festive period can be a particularly emotional time, especially if your separation is recent.

You and your former partner need to consider your child’s age, feelings and their routine. Any major deviation from their norm could be detrimental, and cause upset across Christmas and New Year. Although this may not be preferable for either parent, sticking to their routine may be best for the child.

If your child or children are old enough, you may be able to discuss what they would like to do over the Festive period and make child arrangements accordingly, given they are fair.

Make sure to follow your plan

Whilst enjoying the festivities, you may want to spend more quality time with your child and ignore any arrangements. But it’s paramount that you follow your child arrangement plan as closely as possible.

Although you may need to allow for some flexibility, making sure to stick to the plan gives your child the peace of mind and routine they may need during an emotional period.

Closely following your plan can also minimise the risk of disagreements between you and your former partner. Any significant disputes could impact your child and taint their enjoyment of the Festive period.

To ensure both parents are on the same page, we recommend putting the child arrangement plan in writing, either physically or digitally.

Seek professional advice if necessary

Most couples should be able to make child arrangements over the Festive period without the help of a professional, by trying to be fair, amicable and understanding. But if communication between you and your former partner is difficult, arrangements can be hard to organise.
