Holiday trip results in fractured elbow
Whilst staying at a holiday park in the South of England with her children, our client fell over the edge of a kerb due to lack of adequate lighting and as a result suffered a fractured elbow.
The client is a nurse and as a result of her injuries, she was unable to carry out her duties for several weeks causing a loss of wages. She had to rely heavily on friends and family to help her with childcare, personal care, housework, gardening and transport before she was able to drive again and return to work.
She instructed our head of department, Jonathan Stittle and soon after the claim was submitted, the park’s insurers admitted liability for the accident. Once the client had made a full recovery from her injuries, we obtained a medical report and shortly after that, her case was settled for a five figure sum to include compensation for her injury, lost earnings and the unpaid assistance she received.
Forecourt trip results in broken fingers
Eleanor Buckley was instructed by a lady in her mid-fifties who tripped over a pot hole resulting in fractured fingers in her dominant right hand. The accident took place when walking to the bus stop across the garage forecourt, at which she had just her car.
The Case
Searches were needed to identify the owner of the land. The land owner however did not wish to cooperate and so it took many months to trace an insurer who would deal with the claim.
Further down the line it transpired that there were in fact two possible owners of the land. Eventually we were able to negotiate with one of the insurers who agreed to settle our client’s claim in full before attempting to recover 50% of their outlay from the insurer of the second Defendant.
The Outcome
We obtained a medical report from an Orthopaedic Surgeon who recommended the Claimant had a further X-ray to establish whether the accident had caused or contributed to any long term symptoms. The Claimant underwent the X-ray and it was established that there was some pre-existing but previously unsymptomatic degeneration in her elbow joint. The expert recommended that the Claimant had an injection in her elbow which she arranged via her GP and after many months of negotiations, we were able to settle the claim for £2,800.00.
