If you have been the victim of a violent crime and have suffered physical and/or psychological injury as a result, you may be entitled to compensation under the Criminal Injuries Compensation Scheme. The scheme is administered by the Criminal Injuries Compensation Authority (CICA) and is not connected with the civil courts.
Usually it is not likely to be worthwhile bringing a civil claim against a person who has caused injury, as they are likely to be uninsured or have no substantial personal assets. As a result they are unable to pay for compensation and legal fees. If this does happen to be the case, a claim under the CICA Scheme removes that worry, as the CICA will pay the compensation, which is funded by the state.
As simple as this all may sound, the Scheme does however have strict guidelines which must be adhered to. Damages are paid based on a tariff system which sets out fixed awards of compensation depending on the nature and severity of the injury. Whilst compensation for loss of earnings is not always paid unless the victim has been off work for around six months.
How do I claim?
The procedure is relatively straightforward. Your solicitor will complete an application online and the CICA will liaise with the Police and those who have medically treated you before making an award. Any award can then be appealed, however this process may take up to a year.
