The mediation process
Mediation allows parties in dispute to explore settlement options and negotiate a resolution through an independent mediator.
Even where your charity is not directly involved in the dispute, it is important that your interests are properly represented during the mediation process if you are named as a beneficiary of the estate.
In most cases, mediation is concluded by the production of a settlement agreement that formalises the terms of the proposed resolution. We work with charities to ensure settlement terms are fair, practical and protect your organisation’s interests.
Our experienced legacy protection professionals can act for you throughout the mediation process, or we can be instructed to simply review and advise on the settlement terms. In both cases, we have the expertise to draft, comment on, or negotiate clauses that ensure your best interests are represented.
