Taylor Emmet have recently obtained a £2.95 million settlement for a client in a complex wrongful birth claim. Our client gave birth to a child with spina bifida which, it was alleged, failed to be picked up by two defendants. Our client underwent scans on the NHS and also paid for scans privately. However, both defendants failed to refer to a fetal medicine expert. It was not appreciated that the baby had spina bifida, despite some of the scans showing abnormalities.
Our client has been unable to work to any significant degree as her child requires significant day to day care. It was argued that both defendants should have referred our client for further scans and investigations and that if this had been done, it was likely the spina bifida would have been found. Had this been picked up, it was alleged, our client would likely have been given the option of a termination.
