£90,000 plus costs was obtained in an out of court settlement for a client who went for 8 years without being treated for vitamin B12 deficiency.
Our client’s B12 levels were tested in 2010 and were found to be low however, no treatment was provided to her to address this.
She began experiencing symptoms of fatigue in 2010 and then began with tingling in her hands and feet. Her symptoms progressed over a number of years and affected her balance.
It was alleged the client’s GP failed to identify and treat her complaints of tiredness in 2010 and again in 2013. No further action was taken following a low B12 test in 2013.
Her neurological symptoms worsened and B12 injections were not commenced until 2017. She was then informed in 2018 that her B12 levels had been noted as being abnormal in 2010.
The Claimant’s symptoms improved a little upon receiving the injections however, she continued to experience ongoing unpleasant sensory symptoms which affected her balance and mobility. This has caused her to have occasional falls and she had to reduce her hours at work due to her symptoms.
Our medical expert advised that if B12 injections had been commenced in 2010 and/or 2013, it is likely that the sensory problems would have been reversed and permanent damage to the nerves could have been avoided.
Liability was denied, but settlement was eventually agreed at a Joint Settlement Meeting shortly before trial.
