Paul Fouad acted for a lady in her 60s in relation to a claim about her late husband for a failure to diagnose and treat an aortic dissection. Sadly her husband died aged 57.  Expert evidence was obtained from a cardiothoracic surgeon, accident and emergency consultant and a radiologist before putting forward allegations.

The Defendant, Milton Keynes University Hospital NHS Foundation Trust, admitted liability and that their failings had led to the premature death. It was alleged there was a failure to recognise the Deceased’s symptoms of severe and intense pain at the top of his neck and in his stomach were due to an aortic dissection.  He was discharged with a diagnosis of gastroenteritis and given antibiotics. He died shortly afterwards at home from a severe internal bleed.

Our client was dependant on her husband financially before his death.  The Defendant admitted liability however arguments in relation to the level of damages were strongly contested. Accountancy evidence was required to consider what the Deceased would have earned, had he lived. There were protracted discussions around life expectancy and the valuation of the Deceased’s business. After a Round Table Meeting and lengthy negotiations with the Defendant, a settlement of £475,000 was secured, avoiding the need for a Trial.
