We acted for our client in relation to the death of her partner. In 2021, our client’s partner was killed by his next-door neighbour. He died from a bleed on the brain caused by the assault. The next-door neighbour was convicted of manslaughter.

Following criminal conviction, we supported our client through civil proceedings. Our client initially applied to the Criminal Injuries Compensation Authority (CICA) for compensation in relation to her injuries as a victim of the violent crime towards her partner. Our client was offered £4,340.00 to compensate her for the fatality and financial dependency on her deceased partner. We believed our client was entitled to more.

On behalf of our client, we issued an appeal to review the award made by the CICA. A remote Tribunal Hearing was arranged by the HM Courts & Tribunals service. We undertook substantial preparation such as instructing a Consultant Psychiatrist to report on the extent of our client’s psychiatric injuries.

During the Tribunal Hearing, it was held that our client had a ‘severe’ and ‘permanent’ disabling psychiatric injury causing her to be unable to work for the rest of her life. Accordingly, the Tribunal awarded our client £156,291.87 to account the tragic loss of her partner, psychiatric injury, loss of dependency and past and future loss of earnings.
