We act for a child who, it was alleged, sustained brain damage due to multiple failures by Shrewsbury and Telford Hospital NHS Trust to monitor the pregnancy and further investigate concerning test results. The alleged failures included the hospital wrongly categorising the CTGs (monitoring of the heart rate) as reassuring and discharging the mother rather than carrying out further monitoring and carrying out a caesarean section the day before the birth.

Our client should have been subject to continuous monitoring and a caesarean section to avoid the chronic partial hypoxia. As a result of the defendant’s negligence, our client has been diagnosed with cerebral palsy. It was alleged this was arising from a hypoxic brain injury to the anterior and posterior watershed areas in the brain. She has right hemi-paresis associated with tonal change issues, problems with praxis, visuospatial development, receptive language, urinary urgency and learning disabilities.

She will require extensive additional support for the rest of her life.

Whilst the Defendant admitted some failures in care in the hours before the birth, they denied failures the previous day. They denied that their errors had caused any injury to the Claimant, suggesting the injuries were caused by a stroke.

After settlement negotiations, a percentage split was agreed between the parties on liability with this subsequently being approved by the court. The value of the case will now be investigated and determined.
