Paul Fouad acted for a Claimant who had sustained significant injury following surgery to correct a bunion. She was relatively young and was experiencing increasing pain with a bunion around mid-2016. She was referred to a Podiatric clinic under Sheffield Teaching Hospitals NHS Foundation Trust where a Scarf-Akin osteotomy was recommended.

The procedure was carried out on 10th January 2017. Before the surgery the client had a popliteal nerve block and whilst this was being administered the lady felt extreme pain.

Following the procedure she sustained permanent nerve damage in her right foot, having to mobilise with crutches. Her work hours were consequently restricted.

The possibility of amputation had been discussed but she will likely continue to have ongoing pain and restriction of movement which will impact the rest of her life, including a change in accommodation.
She has understandably also suffered with anxiety and depression as a result of the negligence.

Allegations supported by independent expert evidence were put to the Defendant that they failed to give correct information during the consent process. It was also alleged the Defendant failed to notice and act on the Claimant’s pain during the procedure.

Liability was denied but after protracted court proceedings the case eventually settled a Round Table Meeting, shortly before trial, for £1.2 million.
