The document, described as a \u201cjoint vision statement\u201d, sets out various proposals to make the administration of justice more efficient and accessible across the board.<\/p>\n<p>The digitisation of court processes is part and parcel of the vision; the paragraph on divorce states:-<\/p>\n<p>\u201cFor those people who decide to divorce, the process will be simpler. The majority of these cases involve a very straightforward court process. Only around 2% of cases are contested. Yet the rules and forms are long and complex and have changed little since the 1970s. We will simplify the process and put as much as possible of it online.\u201d<\/p>\n<p>The reference to little having changed since the 1970s is something family lawyers have been campaigning on for years. However, the proposed procedural changes do not deal with any changes to the substantive law; it seems we are stuck with the archaic 1973 Matrimonial Causes Act which involves alleging fault or waiting at least two years for a divorce, see blog <strong><a href=\"https:\/\/www.tayloremmet.co.uk\/blogs\/no-fault-divorce-a-real-possibility\/\">www.tayloremmet.co.uk\/blogs\/no-fault-divorce-a-real-possibility<\/a><\/strong><\/p>\n<p>Even though the bases for divorce will not be changed any time soon, the process can be made less painless if it is dealt with quickly and efficiently by the courts.<\/p>\n<p>The administration of divorce work went through a sea change in 2014\/15 with the introduction of divorce centralisation. Since November 2014 all divorce petitions in South Yorkshire and Humberside have been sent to Doncaster. Divorce petitions in London are dealt with in Bury St Edmunds.<\/p>\n<p>When we talk about divorce, it is the paperwork involved in progressing the actual divorce. Any court hearings relating to finances or children continue to be heard at the court local to parties.<br \/>\nOur experience is that since the centralisation of divorce proceedings in Doncaster, the divorce process is now taking longer. Instead of quoting a 6 month timescale for a divorce, we now say it will take around 8 months or possible longer. Practitioners have even received a letter from the court saying not to contact them to chase divorce paperwork as dealing with phone calls is taking up too much time.<\/p>\n<p>Whilst we welcome any steps which will improve efficiency, the move to an online divorce court must be properly resourced; if it is a cost cutting exercise then this will undoubtedly lead to further delays and frustration.
