Failure to adapt may expose landlords to increased enforcement action, penalties and difficulty recovering possession.<\/span><\/p>\n<h2><span>Tenancy Structure<\/span><\/h2>\n<p><span>From 1 May 2026:<\/span><\/p>\n<ul>\n<li><span>Fixed-term Assured Shorthold Tenancies (ASTs) are abolished<\/span><\/li>\n<li><span>All residential tenancies are assured periodic (rolling) tenancies<\/span><\/li>\n<li><span>Tenancies will have no fixed end date<\/span><\/li>\n<li><span>Tenants may leave at any time by giving two months\u2019 notice<\/span><\/li>\n<\/ul>\n<p><span>These reforms require landlords to review and update all standard tenancy documentation.<\/span><\/p>\n<h2><span>Possession of Property<\/span><\/h2>\n<ul>\n<li><span>Section 21 (\u201cno-fault\u201d) evictions are abolished<\/span><\/li>\n<li><span>Possession may only be recovered by relying on Section 8 grounds<\/span><\/li>\n<li><span>The number of statutory grounds for possession increases from 17 to 37<\/span><\/li>\n<\/ul>\n<p><span>New grounds include where the landlord:<\/span><\/p>\n<ul>\n<li><span>Intends to sell the property<\/span><\/li>\n<li><span>Wishes to move into the property or house a close family member<\/span><\/li>\n<\/ul>\n<p><span>Additional changes include increased rent arrears thresholds (13 weeks for weekly rent or 3 months for monthly rent) and a requirement that any Section 21 notices served before 30 April 2026 must have court proceedings issued by 31 July 2026.<\/span><\/p>\n<h2><span>Rent Controls<\/span><\/h2>\n<ul>\n<li><span>Rent increases limited to once per year with at least two months\u2019 notice<\/span><\/li>\n<li><span>Automatic rent review clauses are no longer effective<\/span><\/li>\n<li><span>Tenants may challenge rent increases at the First-tier Tribunal<\/span><\/li>\n<li><span>Landlords may not require more than one month\u2019s rent in advance<\/span><\/li>\n<li><span>Rental bidding is prohibited<\/span><\/li>\n<\/ul>\n<h2><span>Tenant Rights and Compliance<\/span><\/h2>\n<ul>\n<li><span>Tenants may request to keep pets and refusals must be reasonable<\/span><\/li>\n<li><span>Discrimination against tenants on benefits or with children is unlawful<\/span><\/li>\n<li><span>Compliance with the Decent Homes Standard<\/span><\/li>\n<li><span>Mandatory compliance with Awaab\u2019s Law for property hazards<\/span><\/li>\n<li><span>Compulsory landlord registration and Landlord Ombudsman membership<\/span><\/li>\n<li><span>Enhanced enforcement powers and penalties<\/span><\/li>\n<\/ul>\n<h2><span>Immediate Actions for Landlords<\/span><\/h2>\n<ul>\n<li><span>Ensure written tenancy agreements are in place<\/span><\/li>\n<li><span>Serve the government-prescribed Information Sheet by 31 May 2026<\/span><\/li>\n<li><span>Plan for increased compliance, repair obligations and regulatory changes<\/span><\/li>\n<\/ul>\n<p><span>This blog is for general information only and does not constitute legal advice.
