However, there are a few important exceptions and practical steps that are worth knowing about.<\/p>\n<h3><strong>Does the State Pension stop immediately?<\/strong><\/h3>\n<p>Yes. If the State Pension is already in payment, then it normally stops at the end of the week in which the person dies. Any payments made after death will usually need to be repaid to the Department for Work and Pensions (DWP).<\/p>\n<p>This is why it\u2019s important to notify the DWP as soon as possible after a death. \u00a0It can often take several months for the DWP to calculate any overpayment and to decide if they do intend to recover any overpaid monies from the estate.<\/p>\n<p>This can sometimes cause problems when any overpayment is recovered after the estate has already been distributed to the beneficiaries.<\/p>\n<p>On the flip side, sometimes the state pension is underpaid to the date of death and the executor or administrator of the estate will need to make a claim for this.<\/p>\n<h3><strong>What happens if the death occurs before State Pension age?<\/strong><\/h3>\n<p>If a person dies before reaching State Pension age, there is no entitlement that forms part of their estate or can be inherited.<\/p>\n<p>Likewise National Insurance contributions made during the person\u2019s lifetime are not refunded.<\/p>\n<h3><strong>Can a husband, wife or civil partner inherit a State Pension?<\/strong><\/h3>\n<p>Generally speaking, a pension cannot be inherited.<\/p>\n<p>In some very limited circumstances under the old rules (pre-April 2016), a surviving spouse or civil partner <u>may<\/u> be entitled to receive extra State Pension, but this depends on when their deceased spouse\/partner reached State Pension age and which State Pension scheme applied. The rules are complex and the surviving spouse or civil partner should take further advice.<\/p>\n<h3><strong>Does State Pension form part of the estate?<\/strong><\/h3>\n<p>No. Other than any arrears due at death, the State Pension does not form part of the estate and cannot be left to beneficiaries in a will. It also cannot be inherited in the same way as savings, property, or private pensions.<\/p>\n<h3><strong>What should executors or families do?<\/strong><\/h3>\n<p>After a death, it\u2019s important to:<\/p>\n<ul>\n<li>Register the death and inform the DWP promptly<\/li>\n<li>Check whether any pension (and other DWP benefits) payments have been made after death<\/li>\n<li>Ensure any overpayments are repaid to the DWP<\/li>\n<li>If there is a surviving spouse or civil partner, check whether they may be entitled to an increased State Pension or any Bereavement Support payments.<\/li>\n<\/ul>\n<p>At Taylor Emmet, we regularly guide executors and families through estate administration and help them understand what does, and does not, form part of the estate.
