Have an Affair\u201d, is aimed at \u201cattached\u201d people wanting to have liaisons &#8211; the nature of which can be chosen from a drop down list ranging from \u201csomething short term\u201d to \u201canything goes\u201d.<\/p>\n<p>There are 33 million registered users of the site worldwide and news reports on 25<sup>th<\/sup> August 2015 linked two suicides to users\u2019 details having been leaked.<\/p>\n<p>Family law firms have reported an increase in enquiries since the information was published.<\/p>\n<p>Adultery is one of the five \u201cfacts\u201d which can be relied upon to demonstrate to the court that a marriage has broken down irretrievably; the other facts being behaviour and periods of separation.<\/p>\n<p>Current divorce law is the 42 year old <a href=\"https:\/\/www.legislation.gov.uk\/ukpga\/1973\/18\">Matrimonial Causes Act 1973<\/a>. As a legal concept adultery is rooted in ancient history and in some countries is still a crime.<\/p>\n<p>Many family lawyers feel that adultery as a ground for divorce is outdated. Whilst it is true that adultery may be responsible for many marriage break downs, there is little to be gained by seeking to blame one of the parties at already difficult and traumatic time.<\/p>\n<p>Indeed, the representative body for family lawyers Resolution included in its Manifesto for Family Law a proposal that the law on divorce be changed to allow people to divorce without blame\u00a0\u00a0 (see blog <a href=\"https:\/\/www.tayloremmet.co.uk\/blogs\/resolution-launches-family-law-manifesto-part-1\/\">https:\/\/www.tayloremmet.co.uk\/blogs\/resolution-launches-family-law-manifesto-part-1\/<\/a> ).<\/p>\n<p>Some people may be surprised to learn that adultery makes no difference to the way the law deals with financial settlements arising out of divorce.<\/p>\n<p>The most a Petitioner (person applying for the divorce) can seek financially is an order that the Respondent (the other party)\u00a0 \u00a0pays the costs of the divorce itself. Such costs are usually around \u00a31,000. The court can also order that a named \u201cCo-Respondent\u201d pays towards these costs.<\/p>\n<p>The details of a named Co-Respondent appear on the divorce petition and they are served with the papers. The consequences of this can have its own, potentially devastating consequences if an unsuspecting spouse or partner is alerted to the adultery. Since a change to the court procedure rules in 2011 solicitors have been actively discouraged from naming third parties as Co-Respondents.<\/p>\n<p>It can be difficult to convince a court to grant a divorce based on adultery if the Respondent to the proceedings will not admit that the adultery has taken place. To avoid this problem solicitors usually write to the proposed Respondent asking if they agree to the divorce by asking them to sign a \u201cconfession statement\u201d.<\/p>\n<p>The proof required for an adultery divorce these days is certainly not as bad as it used to be &#8211; the old fashioned scenario of the private detective taking a staged photograph of the husband in a hotel room- but the idea of confession statements still does not seem quite right in this day and age.<\/p>\n<p>The advice we give to clients is that it is likely to be easier to get a divorce through the court if it is based on behaviour. Any inappropriate relations with third parties can be classed as behaviour the Petitioner finds unreasonable.\u00a0 Of course, if the parties have been separated for more than two years then we would much prefer to go down the route of not alleging any blame at all.<\/p>\n<p>One final point which should be noted is that it is not possible to dissolve a civil partnership or end a same sex marriage on the grounds of adultery.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The revelation that Canada based internet site Ashley Madison has been the victim of hackers has been the subject of widespread media attention.
