Even if a <a href=\"\/personal\/inheritance-tracing\/intestacy\/\">parent dies without a will<\/a> leaving a surviving spouse or civil partner, the biological children are typically entitled to share the estate alongside the surviving spouse or civil partner according to fixed amounts subject to the size of the estate.<\/h4>\n<p>The impact of an adoption order is that the legal relationship between the child and their birth parents is severed. For the purpose of intestacy, the impact is that the child no longer has any rights of <a href=\"\/personal\/inheritance-tracing\/\">inheritance <\/a>from either their biological parents or biological family. Instead, they are treated as a permanent member of their adoptive family and would inherit accordingly. Biological children and adoptive children therefore have equal standing and adopted children have the same inheritance rights as biological children of the adoptive parents. There is no legal distinction between the two under intestacy laws. <\/p>\n<h3>Court of Appeal<\/h3>\n<p>In a recent case, the Court of Appeal were asked to reconsider the permanence of adoption in the UK legal system.<\/p>\n<p>The case involved an adoptive mother seeking to revoke the adoption orders of her two children, who had been adopted several years prior. Despite the support of all family members for the revocation, the court concluded that it lacked the jurisdiction to set aside the adoption orders based solely on welfare considerations. <\/p>\n<p>Adoption orders in the UK are intended to be final and irrevocable, providing legal certainty and stability for the child. The Court of Appeal reaffirmed this in their decision and the court highlighted that revocation is only permissible in cases of procedural irregularity or fraud during the original adoption process.<\/p>\n<p>Although the purpose of the case was based on the welfare of the children and not a question as to <a href=\"\/personal\/inheritance-tracing\/\">inheritance<\/a>, the irrevocability of adoption orders has significant implications for intestacy laws. The permanence of adoption ensures that inheritance rights are clear and stable, preventing potential disputes over estate distribution. Should this change, there may be significant questions about whether a child\u2019s adoptive status could be changed in an attempt to benefit from the inheritance of the biological family or, if an order could be revoked, the rights of the child to inheritance under their adoptive parents.<\/p>\n<p>The Court of Appeal&#8217;s decision has ensured consistency and reinforced the legal principle, but as a private client practitioner, it will be interesting to monitor this case and any future appeals to the Supreme Court. <\/p>\n<p><strong>Could a change in the law surrounding the inheritance rights of adoptive children be on the horizon if an appeal was successful?<\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Under existing intestacy laws, biological children automatically inherit from a deceased parent who dies without leaving a surviving spouse or civil partner.
