For most separating couples, issuing court proceedings is a last resort. However, it is not unusual for one party not to participate properly \u2013 whether this is by refusing to share information about financial assets, provide information in time or attend court for hearings.<\/p>\n

This is sometimes because they don\u2019t understand what is going on, don\u2019t want to go to court or just to annoy the other party! Sometimes the other person just buries their head in the sand, hoping that if they ignore what is going on, it will just go away. This can be incredibly frustrating for the party wanting to make progress and resolve the financial settlement.<\/p>\n

There are steps that can be taken to encourage participation with the court process. The first is an application for a penal notice, which can then be attached to a future order of the court.<\/p>\n

A penal notice warns the other person that if they fail to comply with the court order, they may be held in contempt of the court and that the court can impose consequences. Sometimes this warning can be enough to persuade the other party that it is better to engage in the process than risk negative orders from the court.<\/p>\n

If the other party then breaches the order again, you can apply to the court for committal proceedings. You will need to be able to prove to the court beyond reasonable doubt that the other party has not done what they were ordered by the court to do and that it was something that they were capable of doing. This may not be an easy process and will require several further hearings and service of documents.<\/p>\n

If the court is satisfied these requirements are met, it has a number of options;<\/p>\n

    \n
  1. No Penalty<\/li>\n
  2. Confiscation of assets<\/li>\n
  3. A fine<\/li>\n
  4. Custodial sentence of up to 2 years<\/li>\n<\/ol>\n

    Imposing these consequences can be used to uphold the authority of the court and encourage compliance in the future. However, it can also be to punish the person who is not complying with the court orders, due to the impact they are having on the other party and the process.<\/p>\n

    The court sees a custodial sentence as an absolute last resort, but there are recent cases that show that the court will still order them in certain circumstances. This is particularly where the failure to comply with the court order is deliberate, over a long period of time and without remorse or apology, and without any indication of intention to comply with the orders moving forwards. Recently in Brown v Brown [2024] EWFC 181<\/em>, the court found that the contempt and conduct in this case was so serious that only a custodial sentence was justified and the respondent was arrested and spent 21 days in prison. This was due to repeated compliance failures, deliberately breaching the orders and lack of engagement.<\/p>\n

    In Williams v Williams [2023] EWHC 2479,<\/em> the court issued an arrest warrant for one of the parties. The main problem in this case was the failure of the respondent to file a Form E (a financial information form) and disclose their assets \u2013 meaning that the case couldn\u2019t continue. In a final attempt to encourage the respondent to comply with these requirements, they were sentenced to 56 days in prison which was suspended for 28 days to allow the respondent time to provide the information.<\/p>\n

    It is very important for all parties within court proceedings, regardless of who has started them, to understand the serious consequences of failing to comply with orders of the court. It can also be very expensive and time consuming to go through the additional process of trying to encourage enforcement via committal proceedings and should only be considered as a last resort.<\/p>\n

    In some cases though, they are an absolutely essential tool to progress the court proceedings.<\/p>\n
