Having spoken to thousands of people going through this experience, I have no doubt it is true.<\/p>\n<p>This emotional turmoil makes it all the harder to consider the practicalities of a separation, which is why it is wise to seek professional advice before the situation deteriorates and your options are reduced.<\/p>\n<p>Here are some of the questions I am asked most frequently by clients.<\/p>\n<p><strong>Do we need a divorce straightaway?<\/strong><\/p>\n<p>The quick answer is no, it is possible to delay divorce proceedings until you have been apart two years. Some people can\u2019t live in limbo that long and other options are available. There are some advantages to divorcing sooner rather than later, particularly relating to financial issues.<\/p>\n<p><strong>What are we going to do with the kids?<\/strong><\/p>\n<p>Arrangements for children are usually left to the parents, if possible.<\/p>\n<p>It is accepted wisdom that children adjust better to separation if they continue to have a relationship with both parents. In the aftermath of an acrimonious split, it can be hard to communicate with your ex, but plans have to be made.<\/p>\n<p>One option is to consider mediation. This provides a safe and controlled environment for you to talk about what is best for your children and work things out. The alternative is to involve the courts, which should be avoided if at all possible. Proceedings do nothing to ease the adjustment period and can be extremely stressful, not to mention expensive.<\/p>\n<p>Most importantly, it is better for children to see their parents working together to do what is best for the family.<\/p>\n<p><strong>How am I going to manage financially?<\/strong><\/p>\n<p>The consequences of divorce on a couple\u2019s finances are often the most worrying aspect.<\/p>\n<p>It is natural to feel your security is under threat and that you should aim to sort things out without incurring massive legal fees. Most people avoid consulting a solicitor for fear of the expense and often end up settling for less than they are entitled.<\/p>\n<p>If you do find yourself in this situation, you need to seek legal advice, if only to have your options explained and learn more about the help and support available. You can then make an informed decision.<\/p>\n<p>I have had the pleasure of meeting numerous local residents at our Dronfield office, usually for a fixed fee appointment that lasts approximately one hour. This is followed up with a letter confirming the advice provided, giving people a solid base from which to move forward. There is no obligation to instruct Taylor&amp;Emmet or do anything further.<\/p>\n<p>If you do decide to pursue your separation with us, you will receive straightforward information on the potential costs and timescales at the outset.<\/p>\n<p><strong>Mediation<\/strong><\/p>\n<p>As a qualified mediator, I can help resolve the problems arising from a divorce, not only in relation to children, but also financial matters.<\/p>\n<p>The aim is to avoid going to court by discussing issues with an independent third party. It often leads to a better understanding of your ex\u2019s point of view and makes it possible to implement new arrangements that are workable and practicable. There is a charge for mediation, but it is much more cost effective than legal proceedings.<\/p>\n<p>To help clients determine whether this process is right for them, we hold Mediation Information and Assessment Meetings at our Dronfield office. Each party will have a separate appointment with the mediator, who will certify that you have attended.
