{"id":5260,"date":"2024-02-06T12:19:59","date_gmt":"2024-02-06T12:19:59","guid":{"rendered":"https:\/\/www.tayloremmet.co.uk\/blogs\/?p=5260"},"modified":"2024-02-06T13:03:09","modified_gmt":"2024-02-06T13:03:09","slug":"plans-for-compulsory-mediation-for-separating-couples-are-ruled-out","status":"publish","type":"post","link":"https:\/\/www.tayloremmet.co.uk\/blogs\/plans-for-compulsory-mediation-for-separating-couples-are-ruled-out\/","title":{"rendered":"Plans for compulsory mediation for separating couples are ruled out"},"content":{"rendered":"<h4>On Friday 26th January 2024, the Government shelved their plans of making mediation mandatory for separating couples but would instead ensure parents are offered early legal advice to settle disputes, with <a href=\"httpss:\/\/www.tayloremmet.co.uk\/personal\/family-matrimonial\/family-law-mediation\/\">mediation<\/a> still being prioritised.<\/h4>\n<p>In March 2023, the Government announced their plans to make mediation mandatory in low-level separation court cases, such as custody of children and financial arrangements. Former Justice Secretary, Dominic Raab suggested that by not attending Court, separating couples and their children would experience less stress and therefore their mental health would not suffer. He also stated it would free up the Court\u2019s time to make sure that more urgent cases are heard quicker, such as domestic abuse cases.<\/p>\n<p>Although Judges will be tougher in their efforts to encourage mediation, to avoid the complications and expense of a Court hearing, they recognise that divorce isn\u2019t \u2018one size fits all\u2019.<\/p>\n<blockquote><p><a href=\"httpss:\/\/www.tayloremmet.co.uk\/people\/dawn-lowry\/\">Dawn Lowry, Associate and Accredited Family Mediator<\/a> who works at our Rotherham office, commented: \u201cThe MOJ was cautioned against this when the idea was proposed. Legal advice is important. It not only provides advice but also provides a reality check, manages unrealistic expectations, assesses a client\u2019s suitability for mediation. Early legal advice helps reduce conflict early on and helps clients better understand their case and their options. This will increase significant benefits for both mediation and the court processes.<\/p>\n<p>We will continue to offer <a href=\"httpss:\/\/www.tayloremmet.co.uk\/personal\/family-matrimonial\/family-law-mediation\/\">family mediation<\/a> as a choice despite last week\u2019s announcement as it is a less acrimonious and a more cooperative way of successfully working your way through the process of a separation or divorce. Lots of clients want to avoid litigation and improve communication which mediation affords them.\u201d<\/p><\/blockquote>\n<h4><strong>\u2018Resolution Together\u2019 \u2013 the two clients, one lawyer approach<\/strong><\/h4>\n<p>Despite the Government\u2019s decision, our ground-breaking <a href=\"httpss:\/\/www.tayloremmet.co.uk\/personal\/family-matrimonial\/resolution-together\/\">\u2018Resolution Together\u2019<\/a> service is still available for those considering separation.<\/p>\n<p>The exclusive service allows the couple to manage their separation or divorce together, supported by one legal professional \u2013 perfect for those separating amicably.<\/p>\n<p><a href=\"httpss:\/\/www.tayloremmet.co.uk\/our-people\/?_people_search=family-law\">Taylor Emmet\u2019s Family team<\/a> introduced Resolution Together for couples who want to separate cost-effectively and cooperatively, without the need for separate legal representatives.
