The reforms follow an independent review by Clare Wade KC from March 2023, which set out a raft of recommendations to alter the sentencing position in relation to domestic homicides.<\/strong><\/p>\n<p>In response to Clare Wade KC\u2019s review, the government has set a number of actions, including:<\/p>\n<ol>\n<li>Introduce coercive and controlling behaviour and the use of excessive or gratuitous violence as aggravating factors within the sentencing guidelines;<\/li>\n<li>Launch a public consultation to consider whether a higher sentencing starting-point of 25 years should be introduced for homicides following a history of controlling and coercive abuse.<\/li>\n<\/ol>\n<p>Justice Secretary Dominic Raab has stated that the government will \u201cdo everything [it] can to protect vulnerable women\u201d and that the proposals will result in \u201clonger jail sentences for those who kill women in the home\u201d.<\/p>\n<h3>Coercive and Controlling Behaviour<\/h3>\n<p>Under the current regime, the fact that many domestic killings are preceded by years of abuse and coercive control is not accounted for. Such behaviour is not considered to be an aggravating or mitigating factor in sentencing decisions for domestic murders.<\/p>\n<p>This fact was highlighted in Ms Wade\u2019s report, and consequently the government has announced its intention to include coercive and controlling behaviour as an aggravating factor. This will mean that, where a person kills their partner or ex-partner after subjecting them to long periods of coercive and controlling behaviour, the sentence which they are to receive will be increased. However, no comment has been made as to whether such behaviour will also be included as a mitigating factor.<\/p>\n<p>Whilst the full details of the government\u2019s reforms are yet to be announced, the proposal has been greatly welcomed by campaigners who wish to see domestic murderers sufficiently punished for taking the life of their partner or ex-partner.<\/p>\n<h3>\u2018Overkill\u2019<\/h3>\n<p>The government has also announced its intention to change the law so that \u2018overkill\u2019, which is the use of excessive or gratuitous violence, is included as an aggravating factor when sentencing domestic murderers. This reform has been greatly welcomed by campaigners, particularly those who have lost family members who have been killed by their partner or ex-partner as a result of greater violence than would be necessary to kill them.<\/p>\n<p>Ms Wade\u2019s report found that overkill accounted for 47% of the cases which she reviewed whilst in the process of completing her report, which highlights the severity of the issue at hand. Additionally, the fact that the government has acknowledged the necessity to consider overkill when sentencing offenders is a positive step forward given that, where overkill is present in a domestic murder, the reforms will result in longer sentences.<\/p>\n<h3>25-year starting point<\/h3>\n<p>Currently, most domestic murders have a sentencing starting point of 15 years. However, campaigners have been calling on the government to increase this to 25 years for murders committed following a history of controlling and coercive abuse.<\/p>\n<p>The government has now recognised these calls, announcing that a public consultation will be held to determine whether a higher sentencing starting point of 25 years should be introduced. However, it is worth noting that Ms Wade does not support this recommendation in her report.<\/p>\n<h3>Looking to the future<\/h3>\n<p>Whilst the government\u2019s proposals certainly do not fully impose Ms Wade\u2019s recommendations, steps are clearly being taken to ensure that domestic killers are sufficiently punished in proportion to the gravity of their offences.<\/p>\n<p>The government intends to publish its full response to Ms Wade\u2019s report in Summer 2023, along with the public consultation, which will provide greater clarity as to the substance of the legal reforms.
