{"id":4495,"date":"2022-06-23T13:36:18","date_gmt":"2022-06-23T13:36:18","guid":{"rendered":"https:\/\/www.tayloremmet.co.uk\/blog\/wordpress\/?p=3737"},"modified":"2022-06-23T13:36:18","modified_gmt":"2022-06-23T13:36:18","slug":"claims-on-behalf-of-children-and-protected-parties","status":"publish","type":"post","link":"https:\/\/www.tayloremmet.co.uk\/blogs\/claims-on-behalf-of-children-and-protected-parties\/","title":{"rendered":"Claims on behalf of Children and Protected Parties"},"content":{"rendered":"<p>If a child (anyone under the age of 18) or a person who is not capable of looking after their own affairs is injured we are often asked if they can bring a claim.\u00a0The simple answer to this is yes.<\/p>\n<p>The claim would be run in a similar way to other personal injury claims, the only difference being that any compensation awarded would need to be approved by a Court and would need to be paid into a special fund for the benefit of the injured person at the end of the claim. The process is designed to ensure that the child\/protected party\u2019s interests are looked after by the Court.<\/p>\n<h4><strong>Who will represent them?<\/strong><\/h4>\n<p>A child or protected party will need a Litigation Friend to represent them. This is generally a role undertaken by an adult next of kin but can be anyone who is trusted to look after the affairs of the relevant party.<\/p>\n<p>The role of the Litigation Friend will be to provide instructions in relation to the progression of the claim, ensure the injured person attends relevant appointments and to sign all legal documents on their behalf. They will effectively be running the claim on behalf of the relevant person.<\/p>\n<h4><strong>Protected Parties<\/strong><\/h4>\n<p>Medical evidence will be required from a treating physician to confirm that the person is not able to look after their own affairs and\/or to instruct a solicitor and requires assistance in relation to the same.<\/p>\n<p>This information will be obtained by the Solicitor and is generally obtained via a form completed by a GP or a psychiatrist. The process of obtaining this information is straightforward.<\/p>\n<h4><strong>Settlement<\/strong><\/h4>\n<p>Once the medical evidence is finalised then a Barrister will be instructed to provide advice as to the value of the claim. This advice will then be placed before the Court at a hearing when formal approval of the settlement takes place<\/p>\n<h4><strong>Court Proceedings<\/strong><\/h4>\n<p>Once settlement has been agreed then the Court\u2019s formal approval is required. The Judge will need to be confident that the person has either fully recovered from the injuries or certain what the prognosis will be going forward (in more serious injury claims where a full recovery is not possible).<\/p>\n<p>The Court will take into account the valuation advice provided by the Barrister when considering approval.\u00a0If the Judge is satisfied that the settlement is reasonable then they will approve it.<\/p>\n<p>If the claim is for a child and it is a small sum of money, then it is possible to request that payment be made into a Child Trust Fund or Junior ISA which cannot be accessed until the child turns 18 when the full amount plus accrued interest will be paid to the injured party.<\/p>\n<p>For more significant levels of compensation or for protected parties, the money will be paid into the Court Funds Office or the Court of Protection and will be invested suitability and interest will accrue. If a payment out of the fund is needed for the benefit of the child or protected party for medical or educational reasons such as to pay for aids and appliances or a specific need it can be requested. An application (request) will need to be made to the Court for consideration. If the Court considers that the request is reasonable then the payment will be released.<\/p>\n<p>In those cases, the full amount of the award plus interest is still paid to the child when they attain the age of 18. The Court of Protection normally manages large funds for protected parties and communicates with their solicitors about payments required.<\/p>\n<p>The system is designed to safeguard the child and protected party and to ensure that the monies are used for the benefit of the relevant person.<\/p>\n<p>As with all cases, the sooner you instruct a Solicitor the better it is for the claim.
