When people hear that their Personal Injury case is \u201cgoing to court\u201d it can often be a scary thought.<\/p>\n

The proceedings take place in a civil court and there will be no jury. There are generally no people in the public galleries and the Judge and barristers are usually very pleasant. In most cases, none of the barristers or the Judge will be wearing wigs or even gowns.<\/p>\n

Nearly all of our clients, whose claims have ended up in a civil trial, have said that the experience was nowhere near as bad as they had feared. It is often a good idea for clients to visit their County Court before their own hearing to watch other cases so they know what to expect and we would encourage our clients to do this.<\/p>\n

What is the likelihood of my claim going to court?<\/span><\/strong><\/h3>\n

The likelihood of your PI claim going to court at all is very small indeed. Although accurate statistics are not available, we assess that less than 3% of PI claims end up in a court hearing. Most claims are settled out of court. Of those cases that do reach a final court hearing, nearly all do so because the client wants to go there. That is usually because they stand to gain a large sum in compensation and the prospects of success are likely to make the whole experience worthwhile. Many of these claims are actually settled by negotiation within the Court building on the day of the hearing before the case even starts!<\/p>\n

If your Solicitor tells you that your case is going to Court or that court proceedings have been issued, it can simply mean that your case is in progress and has not yet been settled. It is often necessary to start court proceedings for many reasons, including the following:<\/p>\n

1.<\/span><\/strong> If we have been dealing with insurers who are delaying the case unnecessarily or do not appear to have a correct understanding of the case, the starting of court proceedings effectively removes them from the claim. They have to appoint Solicitors to deal with the matter and they are usually quick to get to grips with the issues and make sensible settlement offers. In many cases, issuing court proceedings can speed up the settlement of the claim.<\/p>\n

2<\/span><\/strong>. If the client has ongoing injuries and the insurers won\u2019t make interim payments which may be needed urgently (for example if the injured person is losing earnings or needs to pay for medical treatment) then issuing proceedings is a good idea as the Court can compel the opponent to make these payments.<\/p>\n

3.<\/span> <\/strong>The Court will manage the case by setting deadlines that must be kept to by the opponent, forcing them to deal with the matter more quickly. If they do not keep to the dates, they may lose the case completely.<\/p>\n

4.<\/span><\/strong> The very issue of proceedings often focusses the minds of insurers who have not paid proper attention to cases beforehand.<\/p>\n

We ensure that our clients have met their barrister before the hearing, know the court procedure and what to expect by way of questions. On the morning of the hearing we meet our clients at court, hold a pre-hearing discussion with the barrister and always try to negotiate a last minute settlement with the opponent, which is often successful.<\/p>\n

It is worth remembering that if court proceedings are issued it is usually to your advantage, so if your solicitor suggests it, don\u2019t be worried!<\/p>\n
