As a result, you might sustain an injury or illness due to your service and wonder whether you can claim compensation for your pain and suffering and other out of pocket expenses.<\/strong><\/p>\n<p>If you suffer an injury or illness as a result of service, you are likely to be able to make a claim regardless of whether you are currently serving in the Forces, or a veteran, and whether you were on the front line or working in a supporting role. Compensation can be paid for both physical and mental injuries and illnesses, such as PTSD.<\/p>\n<p>Should you decide to seek compensation following an injury or illness, there are 3 options to consider.<\/p>\n<h2><span style=\"color: #003a7a;\">Armed Forces Compensation Scheme (AFCS)<\/span><\/h2>\n<p>The AFCS was set up by the government to provide compensation to those who have suffered an injury or illness on or after 6 April 2005 and which was caused or made worse by service. The AFCS also provides compensation in the event of a death which was caused by service.<\/p>\n<p>All serving and ex-serving personnel may make a claim under the AFCS, including Gurkhas, reserve personnel and members of the Special Forces.<\/p>\n<p>The amount of compensation available under the AFCS is calculated using fixed tariffs and its value will depend upon the severity of your illness or injury, rather than the impact it has had on your life. Compensation is capped at a maximum of \u00a3650,000 for the most serious injuries, such as amputations. However, for minor injuries, a much smaller amount of compensation is likely to be awarded. It is also likely that you will need medical evidence to prove the diagnosis of your injury or illness.<\/p>\n<p>Unlike ordinary personal injury claims, there is no need to prove fault on the part of the Ministry of Defence.<\/p>\n<p>There are strict time limits under which a claim under the AFCS must be brought. Generally, the time limit for bringing a claim through the AFCS is 7 years from the date on which you suffered an injury or illness due to service. Although 7 years can seem like a long time, it is important to get in touch with an experienced Solicitor as early as you can because an award will only be made from the date you make a claim and not the date you sustained your injury or illness, which inevitably, may be much earlier.<\/p>\n<p>In order to make a claim under the AFCS, a claim form must be completed and filed with supporting documentation, such as a letter confirming your diagnosis, with the Ministry of Defence. Your application will then be considered, and a decision made as to whether you will be awarded compensation. The Ministry of Defence may also request further information from you, such as a medical report and\/or a copy of your medical records.<\/p>\n<h2><span style=\"color: #003a7a;\">War Pension Scheme (WPS)<\/span><\/h2>\n<p>Unlike the AFCS, compensation under the WPS is only available for veterans who have suffered an injury, illness or death which was caused or made worse by service before 6 April 2005. However, as with the AFCS, the value of compensation is assessed with reference to fixed tariffs which are set by Parliament.<\/p>\n<p>There are no time limits for claiming under the WPS, but it is paramount to start your claim as soon as possible as any compensation will only be paid from the date of the claim, not the date on which an injury or illness is sustained.<\/p>\n<p>As with the AFCS, a claim form is submitted, together with supporting documents, to the Ministry of Defence.<\/p>\n<h2><span style=\"color: #003a7a;\">Making a Civil Claim against the Ministry of Defence<\/span><\/h2>\n<p>In some circumstances, you may decide to bring a separate personal injury claim in addition to a claim under the AFCS or WPS in order to increase the value of your compensation. However, unlike the above schemes, you will need to prove that your injury or illness was caused or made worse by someone else\u2019s negligence and you may need evidence from an expert to prove this if liability is denied.<\/p>\n<p>This type of claim is important to consider, as the schemes outlined above are not designed to compensate your financial losses, such as loss of earnings, expenses incurred travelling to and from medical appointments, therapy and medical treatment costs and paid and unpaid care and assistance.<\/p>\n<p>The schemes outlined above are solely designed to try and compensate for the pain and suffering you have suffered as a result of the injury or illness you sustained as a result of your service. However, a claim for personal injury which is made separately to the above schemes will include compensation for pain and suffering and the financial losses you have incurred as a result of your injury or illness. In addition, the value of compensation which may be paid following a civil case is not capped, and your case will be assessed in accordance with the impact the injury or illness has had on your life.<\/p>\n<p>Like the above schemes, there is a strict time limit in which a case must be brought. Usually, this is 3 years from the date the injury or illness was sustained, or the date you became aware of your injury or illness. Therefore, for some veterans, the time limit in which they must bring a civil claim may have expired, but for others, a civil claim should be considered in addition to bringing a claim under the AFCS or WPS.
