Cruises are more popular than ever with an estimated 1.64 million people in the U.K opting to go on a cruise instead of a traditional resort holiday. Additionally many holidaymakers are opting to travel by ferry to their chosen holiday destination as opposed to flying there. Unfortunately as the number of people who choose to spend their holidays on board ship rises, so does the risk of suffering an accident or injury. As a result we are definitely seeing more of these types of claims.<\/p>\n<p>There are various types of accidents that can occur on cruise ships and ferries which can lead to a claim for personal injuries. The most common types of passenger accidents include:-<\/p>\n<ul>\n<li><strong>Falling Objects<\/strong>: The movement of the boat and\/or the sea conditions can cause problems with falling objects that have not been properly secured.<\/li>\n<li><strong>Slips, Trips and Falls<\/strong>: passengers can suffer an accident even before they leave port. Gangway injuries may occur as passengers embark and disembark. Slips and trips are common, in particular tripping up on stairways and near swimming pools. Over-polished decks can become slippery and lead to falls, particularly in wet weather.<\/li>\n<li><strong>Faulty Equipment<\/strong>: accidents include mechanical defects with the ship itself as well as any equipment available for passengers to use.<\/li>\n<\/ul>\n<p>There have also been claims due to swimming pool accidents, food poisoning, accidents in the course of employment and the ship colliding with another ship or object.<\/p>\n<p><a href=\"https:\/\/www.tayloremmet.co.uk\/blog\/wordpress\/wp-content\/uploads\/2017\/02\/cruise-1578528_1920.jpg\"><img decoding=\"async\" class=\"alignright wp-image-1718 size-medium\" src=\"https:\/\/www.tayloremmet.co.uk\/blog\/wordpress\/wp-content\/uploads\/2017\/02\/cruise-1578528_1920-300x200.jpg\" alt=\"Cruise: Accident at Sea - What if you have an accident on your cruise ship holiday?\" width=\"300\" height=\"200\" \/><\/a>The law involved in making an injury claim for an accident on board a ship is different to the law that applies to an accident that occurs at a hotel or resort. Both Tour Operators and Cruise Lines are bound by the Regulations set out in the Athens Convention, which applies to EU member states. The Regulations state that operators of sea going vessels owe a duty of care in the carriage of passengers by sea and to passengers getting on and off the boat. Accidents at a hotel or resort are covered by the Package Holiday Regulations 1992.<\/p>\n<p>It is worth noting that the Athens Convention only applies to cruises that start and finish in a UK port. It may still be possible to pursue a claim if your trip departed from a foreign port but this would be under the Package Travel Regulations. Also the Athens Convention does not cover domestic cruises around the British Isles.<\/p>\n<p>Another important difference to remember is that usually you have 3 years from the accident date in which to make a personal injury claim, however when the accident or injury occurs on a boat or ship the limitation period is only 2 years. Accordingly the claim must either be settled or proceedings issued before the expiry of the 2 year anniversary of the date of the accident.
