The horrific recent case of Bella-Rae Birch, the 17-month-old who was mauled to death by the family dog in St Helens has brought into renewed focus the dangers posed by domestic animals, even those who are normally benign.\u00a0 In this tragic example, the family dog had been bought just a week earlier.\u00a0 The dog was a breed known as an American Bully XL.\u00a0 This is not a prohibited dog under the Dangerous Dogs Act 1991.<\/p>\n

Data shows there have been eight fatal dog attacks in the UK in the past two years.<\/p>\n

An American bully was responsible for the death of 10-year-old Jack Lis in Penyrheol, Caerphilly in November last year, while two American bulldogs killed 85-year-old great-grandmother Lucille Downer in her back garden in Rowley Regis, West Midlands, on April 2, 2021.<\/p>\n

Another common injury is those caused by cows.\u00a0 As the weather improves, more and more people will be taking relaxing walks in the countryside.\u00a0 Where we are based in Sheffield, we are lucky to have many accessible walks around the Peak District National Park.\u00a0 I have dealt with several claims on behalf of injured people who were attacked by cows, left in fields by farmers through which there is a right of way.<\/p>\n

It is important to remember that, even though there is a right of way, that doesn\u2019t necessarily mean it is safe.\u00a0 In all the cases I have dealt with, the injured person was walking a dog and, whilst we can never know for sure, the dog owners believe the cows were spooked by the dog and went on the attack.\u00a0 Fortunately, all my clients went on to make reasonable recoveries, but many are not so lucky.<\/p>\n

Between 2015-16 and 2019-2020 the HSE investigated 142 incidents involving members of the public and farm workers and cattle. 22 of them resulted in a death. 4 of those deaths involved members of the public, with the remaining 18 being suffered by farm workers.<\/p>\n

There were 65 non-fatal incident involving cattle and members of the public in the same period.<\/p>\n

The National Farmers Union suggested walkers keep themselves safe by following The Countryside Code\u00a0<\/a><\/p>\n

Key ways to stay safe<\/strong><\/h4>\n
    \n
  • Look out for any animals and watch how they are behaving, particularly bulls or cows with calves<\/li>\n
  • Try to avoid getting between cows and their calves<\/li>\n
  • Be prepared for cattle to react to your presence, especially if you have a dog with you<\/li>\n
  • Move quickly and quietly, and if possible, walk around the herd<\/li>\n
  • Keep your dog close on a short lead, and under effective control<\/li>\n
  • Remember to close gates behind you when walking through fields containing livestock<\/li>\n
  • Don’t hang on to your dog if you are threatened by cattle – let it go as the cattle will chase the dog and not you<\/li>\n
  • Don’t put yourself at risk by walking close to cattle<\/li>\n
  • Don’t panic or run – most cattle will stop before they reach you, if they follow just walk on quietly.<\/li>\n<\/ul>\n

    Can I make a claim if I am injured by an animal?<\/h4>\n

    Every animal owner has a duty of care to keep it under control and prevent it from causing injury or damage. If they do not keep their animal under control and it causes injury, you can make a claim against the animal owner.<\/p>\n

    The law has developed in trying to strike a balance for those who are injured, and the keeper of the animal.\u00a0It is not enough just to be injured by the animal.\u00a0 To succeed in a claim, the injured person must prove that the keeper of the animal knew that the animal could behave in that way.<\/p>\n

    To try to give a simple example \u2013 if a dog bit someone who was delivering items to their home, and the keeper or owner knew the dog was likely to do that \u2013 you would be likely to succeed in the claim. The difficulty is proving that the keeper or owner knew this could happen. We would normally look to speak to neighbours, the postal delivery person, the paper delivery person, or anyone who was able to say that the dog in question was known to try to bite and take a detailed witness statement from them.<\/p>\n","protected":false},"excerpt":{"rendered":"
