If you have a query about buying or selling, email marketing@tayloremmet.co.uk<\/em><\/p>\n<p><strong>I am buying a property in a conservation area. What effect will this have on any improvements I plan to make?<\/strong><\/p>\n<p><strong>\u00a0<\/strong>A conservation area is somewhere the council feels is of special architectural or historical interest.<\/p>\n<p>The local planning department will be particularly concerned with preserving or enhancing the character of the area whenever they are considering a planning application and any request to extend or change the use of your property will be scrutinised carefully.<\/p>\n<p>Generally, planners are in favour of preservation and exceptions to the normal planning rules are severely restricted. Any tree in a conservation area is also automatically protected as though it has a preservation order on it.<\/p>\n<p>If you wish to carry out alterations to the house you are buying, I recommend you speak to the local council\u2019s planning officer before committing to the purchase.<\/p>\n<p><strong>My neighbour has a large apple tree and some of the branches overhang my boundary. If the apples drop into my garden can I eat them?<\/strong><\/p>\n<p><strong>\u00a0<\/strong>The apples belong to your neighbour, even if they drop into your garden.<\/p>\n<p>If the overhanging branches are a nuisance and your neighbour refuses to prune them, you are allowed to cut them off, however, the branches and any fruit should be returned.<\/p>\n<p>In these circumstances, it is advisable to write a letter to your neighbour setting out your complaint, giving a date by which the tree should be pruned and confirming that if it is not done, you will trim it yourself.<\/p>\n<p><strong>The flat I am buying has a service charge to cover maintenance and communal areas. How can I make sure it will not increase after I have moved in and that I will not end up paying for repairs carried out before I bought it?<\/strong><\/p>\n<p><strong>\u00a0<\/strong>Your solicitor can make enquiries with the landlord or managing agent to see if there is any impending repair work or other expenditure that may cause the service charge to rise. Similar queries can be raised with the vendors and your solicitor can also inspect the service charge accounts to see if there is a sinking fund to cover major repair work or unexpected expenses.<\/p>\n<p>On the day of completion, your solicitor will arrange for the service charge to be apportioned between you and the vendor. Sometimes it is not possible to split the charge exactly as the figures may not be available. In these cases, a provisional apportionment of the sum is made on a best estimate.<\/p>\n<p>If there has been expenditure that has not yet been paid, your solicitor will probably recommend a sum of money is held back and used to cover any repairs that were carried out before you bought the flat.<\/p>\n<p><strong>I am buying the carpets in my new house. Should I pay the vendor directly or go through my solicitor?<\/strong><\/p>\n<p>Your solicitor is likely to recommend a record is made of the carpet agreement in the contract for the house purchase.<\/p>\n<p>On completion, the money for the carpets should then be paid to your solicitor who will pass it on to the seller\u2019s solicitor.
