I understand I must now have regular electrical inspections carried out on my rental property. Why is this?<\/span><\/strong><\/h3>\nOn April 1, the Electrical Safety Standards in the Private Rental Sector (England) Regulations 2020 came into force. This means landlords are now obliged to provide existing and new tenants with an electrical safety certificate.<\/p>\n
The government takes the welfare of private tenants and the risk of fires extremely seriously and as electrical installations deteriorate over time, it was decided last year that these regulations were necessary to reduce the risk of a fatal or serious accident occurring.<\/p>\n
Landlords are now obliged to carry out mandatory inspections to:<\/p>\n
1.<\/span> <\/strong>Ensure the electrical safety standards are met, during the period their property is occupied by a tenant.<\/p>\n2.<\/strong> <\/span>Ensure every electrical installation in their property is inspected and tested by a qualified person every five years, unless the report from a previous inspection recommends sooner.<\/p>\nAfter the inspection has been carried out, you should receive a report, known as an EICR, that includes the test results and the date the next one is due. You must then supply a copy to your tenant within 28 days of the inspection.<\/p>\n
If you receive a request for a copy of the report from a housing authority, this must be provided within seven days. You should also retain a copy for yourself and give it to the person who carries out the next inspection. Should your property become vacant, you must give a copy of the most recent report to your new tenants and any prospective tenants who wish to see it.<\/p>\n
If the local authority has reason to believe you have not complied with your EICR responsibilities, it can serve a remedial notice requesting you carry out its recommended actions. If you are found to be in breach of your duties under the regulations, you may also be issued with a fine of up to \u00a330,000.<\/p>\n
Hopefully you were already aware of these new responsibilities, but if you have not had the necessary inspection carried out yet, I recommend you do so as a matter of urgency, in order to avoid a potential fine.<\/p>\n
