She had to rely heavily on friends and family to help her with childcare, personal care, housework, gardening and transport before she was able to drive again and return to work.<\/p>\n<p>She instructed our head of department, Jonathan Stittle and soon after the claim was\u00a0submitted,\u00a0the park\u2019s insurers admitted liability for the accident. Once the client had made a full recovery from her injuries, we obtained a medical report and shortly after that, her case was settled for a five figure sum to include compensation for her injury, lost earnings and the unpaid assistance she received.<\/p>\n<h3><span style=\"color: #003a7a;\"><strong>Forecourt trip results in broken fingers<\/strong><\/span><\/h3>\n<p>Eleanor Buckley was instructed by a lady in her mid-fifties who tripped over a pot hole resulting in fractured fingers in her dominant right hand. The accident took place when walking to the bus stop across the garage forecourt, at which she had just her car.<\/p>\n<p><span style=\"color: #003a7a;\"><strong>The Case<\/strong><\/span><\/p>\n<p>Searches were needed to identify the owner of the land.\u00a0The land owner however \u00a0did not\u00a0wish to cooperate and so it took many months to\u00a0trace an insurer who would deal with the claim.<\/p>\n<p>Further down the line it transpired that there were in fact two possible owners of the land. Eventually we were able to negotiate with one of the insurers who agreed to settle our client&#8217;s claim in full before attempting to recover 50% of their outlay\u00a0from the insurer of the second Defendant.<\/p>\n<p><span style=\"color: #003a7a;\"><strong>The Outcome<\/strong><\/span><\/p>\n<p>We obtained a medical report from an\u00a0Orthopaedic Surgeon who recommended the\u00a0Claimant had a further X-ray to establish whether the accident had caused or contributed to any long term symptoms. The Claimant underwent the X-ray and it was established that there was some <span style=\"color: #003a7a;\"><a style=\"color: #003a7a;\" href=\"https:\/\/www.tayloremmet.co.uk\/blog\/wordpress\/pre-existing-condition-acceleration\/\"><strong>pre-existing but previously unsymptomatic<\/strong><\/a><\/span> degeneration in\u00a0her elbow\u00a0joint.
