The Accident<\/strong><\/span><\/h3>\n

This week, John Green has taken instructions from a gentleman who was witness to a frightening accident to his wife.<\/p>\n

They were in a large supermarket close to their home when a very large shelving unit fell directly onto his wife, while he was stood about 15 meters away, powerless to help.<\/p>\n

Fortunately his wife was thrown backwards by the impact of the shelving unit, and her injuries were not as serious as they might have been.\u00a0 Our client initially believed his wife had been crushed and was underneath the unit.\u00a0 Since then, as a result of what he witnessed he has been suffering psychological symptoms and we are in the process of submitting a claim to the supermarket.<\/p>\n

The Case<\/strong><\/span><\/h3>\n

John Green<\/p><\/div>\n

It is possible for a person to witness an accident to another person, and who suffers injury as a result of what they saw, to claim compensation as a \u201csecondary victim\u201d.<\/p>\n

The courts have created a number of tests which must be passed before it is possible for a person to claim as a secondary victim. They must have a relationship of love and affection with the primary victim, they must have witnessed the event or its \u201cimmediate aftermath\u201d, furthermore they must have a \u201cdirect perception of the harm to the primary victim\u201d, and be of reasonable fortitude.<\/p>\n

Each case is decided on its particular facts but, based on instructions from our client, it seems that he will pass the test of a secondary victim, provided the medical evidence is supportive.<\/p>\n

The Accident<\/strong><\/span><\/h3>\n

We were instructed by a gentleman in his mid-thirties who rode to and from work on his scooter. On a sunny summer\u2019s day in 2015, he began the journey to work, unfortunately a car cut across our client\u2019s path and drove into him knocking him from his scooter. The emergency services were called and he was taken to a nearby Hospital. He was diagnosed with torn ligaments and tendons in his right knee which required surgical intervention resulting in a few nights in hospital. He was kept in hospital for a few nights. Our client underwent intensive physiotherapy to assist him with his recovery. He was off work for many weeks and suffered a loss of earnings as a result.<\/p>\n

The Case<\/strong><\/span><\/h3>\n

Primary liability was admitted at the outset. We obtained a medical report on our client\u2019s injuries which recommended that he undergo a further course of intensive physiotherapy to assist him with his recovery. We obtained the opinion of various experts in this matter to establish what treatment was necessary for him to make a full recovery. After arranging the necessary treatment our client was able to return to work.\u00a0 We submitted our offer to the Defendant\u2019s insurer to settle this claim which included a claim for his lost earnings. After many months of negotiations, we were able to obtain damages in the sum of \u00a311,000.00 plus costs.<\/p>\n
