{"id":1601,"date":"2017-01-12T08:04:29","date_gmt":"2017-01-12T08:04:29","guid":{"rendered":"http:\/\/www.tayloremmet.co.uk\/blog\/wordpress\/?p=1601"},"modified":"2017-01-12T08:04:29","modified_gmt":"2017-01-12T08:04:29","slug":"how-we-calculate-what-an-injury-is-worth","status":"publish","type":"post","link":"https:\/\/www.tayloremmet.co.uk\/blogs\/how-we-calculate-what-an-injury-is-worth\/","title":{"rendered":"How we calculate the value of a personal injury claim"},"content":{"rendered":"<p>Compensation, known as damages,\u00a0is awarded when someone has been injured\u00a0in an accident as a result of someone else\u2019s negligence.<\/p>\n<p>Damages in Personal Injuries are split between <strong>General damages<\/strong> and <strong>Special Damages.<\/strong><\/p>\n<p><strong>General damages<\/strong> are to compensate an individual for\u00a0the pain, suffering and loss of amenity they have suffered as a result of the accident\/injury. General damages are calculated by reference to both published Judicial College Guidelines (for judges)\u00a0which suggest upper and lower amounts for specific injuries and a large database previously-reported cases. In complicated cases or where clients have suffered multiple injuries, we take advice from a barrister as to the value of the injury element of a claim.<\/p>\n<p><strong>Special damages<\/strong> are damages for the financial losses a person suffers as a result of the accident. These include both\u00a0past and future losses. Examples of past losses include:-<\/p>\n<ul>\n<li>Loss of earnings<\/li>\n<li>Unpaid care and assistance received from others<\/li>\n<li>Damage to clothing and property<\/li>\n<li>Vehicle-related damage including hire charges<\/li>\n<li>Medical expenses<\/li>\n<li>Mileage<\/li>\n<li>Cost of transport to medical and other appointments including taxi fares, bus and tram fares.<\/li>\n<li>Services paid for due to the injury such as hiring a cleaner, gardener, child minder, decorator or someone else to perform the work that the injured person would have done themselves if they weren&#8217;t injured.<\/li>\n<li>Cancellation charges\u00a0and lost deposits<\/li>\n<li>Ruined holidays<\/li>\n<li>Cost of aids and equipment required<\/li>\n<li>Adaptations to houses and vehicles<\/li>\n<\/ul>\n<p>If the client doesn&#8217;t make a full recovery from their injuries, they\u00a0will often\u00a0be entitled to recover compensation for future losses which might include one or more of the following:-<\/p>\n<ul>\n<li>Lost earnings<\/li>\n<li>Care and assistance required<\/li>\n<li>Future medical treatment and medication<\/li>\n<li>Disadvantage on the labour market<\/li>\n<li>Court of Protection costs<\/li>\n<\/ul>\n<p>These are examples and not meant to be complete lists. Most cases don&#8217;t involve future losses as the majority of injured clients make full or nearly-full recoveries from their injuries.
