{"id":1438,"date":"2018-05-08T13:46:28","date_gmt":"2018-05-08T13:46:28","guid":{"rendered":"http:\/\/www.tayloremmet.co.uk\/blogsite\/?p=1438"},"modified":"2022-07-18T15:11:43","modified_gmt":"2022-07-18T14:11:43","slug":"tribunal-delays-dont-despair","status":"publish","type":"post","link":"https:\/\/www.tayloremmet.co.uk\/blogs\/tribunal-delays-dont-despair\/","title":{"rendered":"Don\u2019t Despair at Tribunal Delays"},"content":{"rendered":"<p><span style=\"font-family: helvetica, arial, sans-serif; font-size: 12pt;\">A headline in The Times last week caught my eye. \u201c<span style=\"color: #003a7a;\"><a style=\"color: #003a7a;\" href=\"httpss:\/\/www.thetimes.co.uk\/article\/tribunals-gridlocked-by-surge-in-claims-wx5b2gwdw\">Tribunals gridlocked by surge in claims<\/a><\/span>\u201d it shouted at me, as I perused the paper over lunch.<\/span><\/p>\n<p><span style=\"font-family: helvetica, arial, sans-serif; font-size: 12pt;\">Yes, we might be experiencing some delays in the tribunal service currently, but certainly here in South Yorkshire, to call them \u201cgridlocked\u201d would be a little overdramatic.<\/span><\/p>\n<h3><span style=\"color: #003a7a; font-size: 14pt;\"><strong><span style=\"font-family: helvetica, arial, sans-serif;\">So what is causing the delays? <\/span><\/strong><\/span><\/h3>\n<p><span style=\"font-family: helvetica, arial, sans-serif; font-size: 12pt;\">The problems are rooted in the Supreme Court\u2019s decision to abolish fees for employment tribunals last year. Whilst this was great news for claimants, the rapid increase in cases was not fully anticipated.<\/span><\/p>\n<p><span style=\"font-family: helvetica, arial, sans-serif; font-size: 12pt;\">When fees were introduced in 2013, the average drop in claims across the UK was 65%. The resulting empty courtrooms meant staffing and judicial resources were managed downwards, in some cases through natural wastage, in response to this reduced demand.<\/span><\/p>\n<p><span style=\"font-family: helvetica, arial, sans-serif; font-size: 12pt;\">The challenge now is for the tribunal service to react quickly and efficiently to its growing workload, whilst still processing current cases. Simply put, additional staff are required as soon as possible, although I suspect budget and target restrictions imposed previously may be restrictive.<\/span><\/p>\n<p><span style=\"font-family: helvetica, arial, sans-serif; font-size: 12pt;\">Increasingly, we are moving towards a situation where future claims will be handled electronically and the tribunal service may also have to consider what impact this ongoing strain on resources will have on its ability to embrace new technology and process these changes efficiently.<\/span><\/p>\n<h3><span style=\"font-family: helvetica, arial, sans-serif;\"><strong><span style=\"font-size: 14pt; color: #003a7a;\">How can T&amp;E help? <\/span><\/strong><\/span><\/h3>\n<p><span style=\"font-family: helvetica, arial, sans-serif; font-size: 12pt;\">Employment solicitors, like me, see the negative impact tribunal delays have on clients and we are doing all we can to manage expectations, by limiting legal costs and alleviating the frustrations caused by having to wait six months or more to have your say.<\/span><\/p>\n<p><span style=\"font-family: helvetica, arial, sans-serif; font-size: 12pt;\">At the outset, or in the early stages of a case, we can also explore the benefits and likelihood of seeking resolution before employment disputes reach a tribunal.
