{"id":1221,"date":"2017-07-27T13:25:53","date_gmt":"2017-07-27T13:25:53","guid":{"rendered":"http:\/\/www.tayloremmet.co.uk\/blogsite\/?p=1221"},"modified":"2017-07-27T13:25:53","modified_gmt":"2017-07-27T13:25:53","slug":"tribunal-fees-unlawful","status":"publish","type":"post","link":"https:\/\/www.tayloremmet.co.uk\/blogs\/tribunal-fees-unlawful\/","title":{"rendered":"Supreme Court Rules Employment Tribunal Fees unlawful"},"content":{"rendered":"<p><a href=\"https:\/\/www.tayloremmet.co.uk\/blogs\/wp-content\/uploads\/2017\/07\/books.jpg\"><img fetchpriority=\"high\" decoding=\"async\" class=\"alignleft wp-image-1228\" src=\"https:\/\/www.tayloremmet.co.uk\/blogs\/wp-content\/uploads\/2017\/07\/books.jpg\" alt=\"Tribunal Fees\" width=\"311\" height=\"208\" \/><\/a>In a momentous\u00a0ruling\u00a0the Supreme Court have ruled that the Government&#8217;s\u00a0policy of requiring Claimants to pay fees to\u00a0bring a claim in the Employment Tribunal is unlawful. Tribunal\u00a0fees were deemed unlawful\u00a0because they\u00a0prevent access to justice\u00a0and\u00a0because they are indirectly\u00a0discriminatory, particularly against women who are more likely to work part time and are therefore disproportionately affect by the fees.<\/p>\n<p>Fees were introduced nearly four years ago to the day by the Coalition Government in order to:<\/p>\n<ul>\n<li>Transfer part of the cost burden from the taxpayer to the users of the Tribunal\u00a0service; and<\/li>\n<li>Reduce\u00a0the number of weak\u00a0or vexatious claims.<\/li>\n<\/ul>\n<p>From July 2013 onwards Claimants have been\u00a0required to\u00a0pay a combined fee of\u00a0up to \u00a31,200, depending on the type of claim. This was argued by many to be outside the reach of most\u00a0potential Claimants\u00a0who by definition are likely to have\u00a0just lost their jobs and therefore the fees\u00a0regime came in for criticism as a barrier\u00a0to\u00a0Claimants seeking to enforce their employment rights.<\/p>\n<p>Despite a fee remission system for Claimants with low household incomes and the ability of the Tribunal to make employers reimburse the fees to successful Claimants the number of Tribunal claims submitted since the introduction of Tribunal fees\u00a0dropped\u00a0by around\u00a070% and the reason most frequently cited by potential Claimants for not\u00a0taking their claim to an Employment Tribunal\u00a0was\u00a0this high\u00a0upfront\u00a0cost.<\/p>\n<p>Whilst the\u00a0Supreme Court\u00a0found\u00a0that the Tribunal system\u00a0benefited wider society by deterring bad employment practice as well as those employees using the service it did not rule that\u00a0the Government&#8217;s aims of transferring the cost onto the users of the system and deterring spurious litigation were invalid.\u00a0The Court&#8217;s Judgment was however clear that the method the Government chose to pursue these aims was unlawful and discriminatory.<\/p>\n<p>The Government responded immediately by\u00a0confirming that fees would no\u00a0longer be accepted for new Tribunal claims and that the \u00a332million collected in fees over the last four years would be repaid. It is difficult to see how this will be done especially in cases which\u00a0were settled\u00a0and whether the Tribunal system\u00a0even have a record of litigation which\u00a0finished years ago.<\/p>\n<p>We will have to wait\u00a0to see if the Government\u00a0make another attempt\u00a0to introduce fees at a lower level but for now it is free again to access the Tribunal system.<\/p>\n<p>Perhaps a bigger question is whether potential Claimants who could not afford to pay Tribunal fees now have a cause of action again despite being out of time to bring a claim. The Tribunal has the\u00a0power to extend time limits in unfair dismissal cases if it was not reasonably practicable to bring a claim in time or where it is just and equitable to do so if the Claimant is alleging discrimination. I see no reason why potential Claimants in this situation could not issue a claim now for free using this\u00a0Supreme Court decision to argue that the time limit to hear their claim should be extended because Tribunal fees\u00a0prevented them from bringing\u00a0a claim initially. This will not however be an option indefinitely as\u00a0the Tribunal&#8217;s power to extend time limits on\u00a0this basis is limited, potential Claimants will therefore lose the right make this argument if they do not act promptly.<\/p>\n<p>There has been something of a predictable backlash against this ruling in\u00a0some parts of the media who have suggested that this decision will lead to a flood of new claims\u00a0but I genuinely think that employers who follow good employment law practice, have up to date HR procedures and employment contracts will have nothing to fear from a Tribunal system which once more allows access to justice for everyone.<\/p>\n<p>If you would like advice as a result of this change in the law please contact us on <span style=\"color: #003a7a;\"><strong>0114 218 4000<\/strong><\/span> or email <strong><span style=\"color: #003a7a;\">info@tayloremmet.co.uk<\/span><\/strong>.<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>In a momentous\u00a0ruling\u00a0the Supreme Court have ruled that the Government&#8217;s\u00a0policy of requiring Claimants to pay fees to\u00a0bring a claim in the Employment Tribunal is unlawful.
