{"id":117,"date":"2014-04-15T10:00:35","date_gmt":"2014-04-15T10:00:35","guid":{"rendered":"http:\/\/www.tayloremmet.co.uk\/blogs\/?p=117"},"modified":"2014-04-15T10:00:35","modified_gmt":"2014-04-15T10:00:35","slug":"parental-involvement-and-child-arrangement-orders","status":"publish","type":"post","link":"https:\/\/www.tayloremmet.co.uk\/blogs\/parental-involvement-and-child-arrangement-orders\/","title":{"rendered":"Parental Involvement and Child Arrangement Orders"},"content":{"rendered":"<p>The Children Act 1989 which deals with cases involving disputes between parents will be amended on 22<sup>nd<\/sup> April 2014 \u00a0to include the new term \u201cparental involvement\u201d and will change the names of certain court orders.<\/p>\n<p>\u201cCustody\u201d and \u201caccess\u201d were abolished when the Children Act 1989 into force and were replaced by \u201cresidence\u201d and \u201ccontact\u201d. The reason for the change at that time was to get away from terminology which suggested that one parent may have ownership of a child and the other parent only has lesser visitation rights. \u00a0A residence order names the person with whom a child lives, and a contact order sets out the times the child spends with the non-resident parent.<\/p>\n<p>The Children Act also brought in the concept of parental responsibility. This encompasses all the rights and responsibilities associated with being a parent; for example, the right to give consent to medical treatment.<\/p>\n<p>The way we describe the law is that it is children who have the \u201crights\u201d and parents have \u201cresponsibilities\u201d. It is the child\u2019s \u201cright\u201d to have a relationship with both their parents provided that it is in their \u201cbest interests\u201d.<\/p>\n<p>A child\u2019s best interests are determined with reference to the \u201cwelfare principle\u201d. The Children Act contains the \u201cwelfare checklist\u201d which sets out the factors a court takes into account. This list includes: the child\u2019s wishes and feelings; their physical, emotional and educational needs; their age, sex and background; the effect of any change in circumstances and whether they are at risk of suffering\u00a0 any harm.<\/p>\n<p>The new law contains a presumption that the \u201c involvement\u201d of both parents will further the child\u2019s welfare unless the contrary is shown. This is not a legal presumption that care of the children should be shared, but rather enshrines in law that it is in a child\u2019s best interest for both parents to be involved in their lives.<\/p>\n<p>The other marked change is that the terms \u201cresidence\u201d and \u201ccontact\u201d shall disappear and be replaced by \u201cchild arrangement orders\u201d. \u00a0A child arrangement order \u00a0may \u201cname the person with whom a child lives, spends time or otherwise have contact\u201d or \u201cwhen a child may live, spend time or have contact with any person\u201d. This is taking further the thinking behind the original Children Act which is to get away from the idea that one parent has more control over a child than the other.<\/p>\n<p>The Government\u2019s stated aim is to \u201csend an important message to parents about the valuable role which they both play in their child\u2019s life\u2026\u201d and to \u201c\u2026encourage separated parents to adopt a less rigid and confrontational positions with regard to arrangements for their children\u201d.<\/p>\n<p>Whether this will have a real impact on decisions of the family courts is not clear.
