{"id":1163,"date":"2016-03-09T19:02:23","date_gmt":"2016-03-09T19:02:23","guid":{"rendered":"http:\/\/www.tayloremmet.co.uk\/blog\/wordpress\/?p=1163"},"modified":"2016-03-09T19:02:23","modified_gmt":"2016-03-09T19:02:23","slug":"making-a-personal-injury-claim-part-3-conditional-fee-agreements-coffee","status":"publish","type":"post","link":"https:\/\/www.tayloremmet.co.uk\/blogs\/making-a-personal-injury-claim-part-3-conditional-fee-agreements-coffee\/","title":{"rendered":"Making a Personal Injury Claim &#8211; Part 3 &#8211; Conditional Fee Agreements &amp; coffee"},"content":{"rendered":"<p>Taylor&#8217;s trip to the Solicitor<\/p>\n<p>Taylor came back to the office this week to talk about Conditional Fee Agreements and making a claim generally.\u00a0 He is still feeling the strain of his injuries\u00a0and insists that\u00a0he is on &#8216;light duties&#8217;.\u00a0 I questioned what duties Taylor had\u00a0managed before, light or otherwise?<\/p>\n<p>Taylor brought photos (see part 1) of the defective pavement which caused his accident.\u00a0 I studied these carefully and we had a constructive interview about making a claim against the Local Authority.\u00a0 Fortunately for other pedestrians and possible victims, the Council had now repaired the area.<\/p>\n<p>We sat down with a coffee (and a saucer of milk)\u00a0and I asked him about the mechanism of his accident, his injuries and the effects on his day-to-day life.\u00a0 I warned him that &#8216;difficulties getting into nightclubs&#8217;\u00a0was unlikely to attract judicial sympathy, but nevertheless, I advised he had a reasonable chance of a successful claim.<\/p>\n<p>I explained to Taylor that, since we didn&#8217;t pay him, he had no way of paying our fees privately.\u00a0 Fortunately, the majority of personal injury work is undertaken on a no-win, no-fee basis.\u00a0 A Conditional Fee Agreement (as it is known) is basically an agreement between the Solicitor and the client that if they recover compensation, then\u00a0the Solicitor is entitled to a success fee which is a percentage (25% max) of the damages.\u00a0 If the client does not win compensation then he has nothing to pay,\u00a0provided\u00a0Taylor cooperates with us and is honest in his dealings with us and does not grossly exaggerate his losses or the effects of his injuries.<\/p>\n<p>Taylor was happy for me to act for him and signed an authority enabling us to submit the claim to the Council&#8217;s insurers online as well as the conditional fee agreement.
