{"id":1020,"date":"2015-10-23T14:18:57","date_gmt":"2015-10-23T13:18:57","guid":{"rendered":"http:\/\/www.tayloremmet.co.uk\/blsblog\/?p=1020"},"modified":"2015-10-23T14:18:57","modified_gmt":"2015-10-23T13:18:57","slug":"office-to-residential-use-permitted-development-rights-to-stay","status":"publish","type":"post","link":"https:\/\/www.tayloremmet.co.uk\/blogs\/office-to-residential-use-permitted-development-rights-to-stay\/","title":{"rendered":"Office to Residential use &#8211; permitted development rights to stay!"},"content":{"rendered":"<p>On 13 October 2015 the Government confirmed in a statement that the temporary permitted development rights to change the use of office accommodation into residential accommodation will be made permanent.<\/p>\n<p>The temporary permitted development rights were due to expire on 30 May 2016, however any developments which have obtained the necessary prior approval (which is somewhat more limited than a traditional planning application) to change the use of a property from office to residential, will have three years in which to &#8216;complete&#8217; the change of use. The definition of &#8216;complete&#8217; is not yet clear and neither is the point as to when the three years run from.<\/p>\n<p>When the temporary rights were introduced in 2013, they were subject to certain exemptions. These will now be removed, albeit not until 30 May 2019. There are no proposals for a further exemption regime. Local authorities, therefore, will have until 30 May 2019 to make Article 4 directions restricting permitted development changes from office to residential use, and thus, if sanctioned, developers will need to make an application for planning in the usual way.<\/p>\n<p>There are proposals that the permitted development rights in this area will be further extended to allow:<\/p>\n<ul>\n<li>the change of use of light industrial buildings to new homes<\/li>\n<li>the demolition of existing office buildings to create new homes.<\/li>\n<\/ul>\n<p>These are subject, of course, to prior approval of limited matters &#8211; details of which are awaited.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>On 13 October 2015 the Government confirmed in a statement that the temporary permitted development rights to change the use of office accommodation into residential accommodation will be made permanent.
