Cases of the Week – RTA & Horse riding injury

Frightening RTA

We were instructed by a young man, who, whilst driving home from work in the early hours of the morning was involved in a frightening collision with a vehicle driven by a foreign lorry driver. The driver veered across the carriageway, striking the Claimant’s vehicle and causing it to collide with the central reservation barrier. The Claimant suffered whiplash injuries to his neck and back together with psychological symptoms.

The Case

We tried to identify the correct insurer for the lorry driver using an online database of insurers but this unfortunately proved fruitless. We therefore contacted the Motor Insurer’s Bureau in Milton Keynes, who after investigating the matter, were able to provide us with the insurer’s English handling agents. We corresponded with the agents for over twelve months as they were unable to obtain confirmation of the circumstances of the accident from the lorry driver. After many months of corresponding with them however, liability was eventually admitted.

The Outcome

Following the admission of liability, we obtained a medical report on the Claimant’s injuries. The medical expert recommended that the Client should undergo a course of extensive physiotherapy, so arrangements were made and he received that treatment. He went on to make a full recovery after which we were obtained damages for him in the sum of £3,750.00

Horse Riding Injury

Jonathan Stittle recently acted for a lady injured when riding her horse on private land.

She and a friend were setting out on a ride when a man who was working nearby startled the horses, causing our client to be thrown off. As a result she suffered a fractured collarbone amongst other injuries.

Fortunately the man’s insurers admitted liability at the outset and paid for our client to undergo extensive rehabilitation in addition to her NHS treatment. She made a near-complete recovery from her injuries and was able to return to her hobby of horse riding. She also received a substantial sum of compensation.
