The Client was about to walk into a large chill freezer as part of her duties at a large supermarket chain when she slipped and fell on liquid which had escaped from the freezer onto the floor. The Client fell heavily onto her right side and suffered a significant injury to her shoulder. She also injured her elbow, hip and suffered significant bruising. She required surgery to repair the damage to her shoulder and surrounding muscles.

The Case

Primary liability was admitted at the outset but we faced significant delays from the Defendant’s insurer who failed to take into account the severity of her injuries. The insurer failed to take into consideration that as a result of the slip the Claimant would not regain full movement of her shoulder and that she would be permanently disadvantaged on the open labour market.

The outcome

After many months of negotiating and gathering further evidence from our expert, we were able to obtain a successful outcome and obtained damages in the sum of £25,000.00 plus legal costs.

The Accident

We settled a claim for a man who, whilst walking along the pavement on his way to his GP surgery fell down due to a defective manhole cover and sustained injuries to his legs, arms and face.

The Case

We initially submitted the claim against the owners of the land i.e. the GP surgery, whose insurers denied liability. It was then established that the GP surgery had employed a contractor to re-surface the area and maintain the grounds. During the works a new manhole cover was purchased and installed. However, the cover was not suitable and did not adhere to the required regulations.

The Outcome

We therefore resubmitted the claim against the Contractor who after many months of negotiating admitted liability in full. We obtained £3,874.94 plus costs for the Claimant which included the cost of his damaged clothing and dentures.
